Here are three scenarios:
1. If you received a new social security card with your new name, use your new name on your income tax return.
2. If you have applied for but not gotten your new social security card, use your previous name. The Social Security Administration shares information with the IRS but it is not instant. If you E-file and your income tax return may get rejected, change your name and E-file again. I have also seen where the return is accepted but the taxpayer gets a letter from the IRS requesting proof of identity.
3. If you have not applied for a new Social Security card with your new name, file under your old name.
