I got denied unemployment and asked to repay them back. I appealed the decision and I have been waiting to hear back. do i mark in my tax return that I had to repay ?

No, since at this point it isn't true, don't include it. You could wait until closer to the filing deadline to file or you could amend if it does come to pass.
