If you want to still file a joint return, you can file an form 8379 for Injured Spouse Relief.

1. Other Tax Situations
2. Miscellaneous Tax Forms under Other Tax Forms
3. Start next to Report an injured or innocent spouse claim
4. Walk through the steps to fill out the innocent spouse relief form.
5. This form is mostly a "Fill out form" versus a question and answer interview type form
