How can I claim my son as a dependent for 2023 if my wife has already illegaly claimed him for the same year and refuses to respond to me.

You can print and mail your return to claim him.  Then the IRS will send you both letters to determine who can claim him.

If she has already claimed him and filed you can’t claim him by efile. You would have to mail your return. The one who can legally claim him is the one with whom he spent the most nights.
