It's not a mistake if they didn't withhold any tax. If your Third Party Sick Pay is reported on a W-2 with an amount in Box 1, it is taxable, even if no tax was withheld. Whether or not it is taxable depends on whether you paid for the cost of the policy or your employer paid for the policy. For more information see:
