If you and your child were claimed as dependents on your fiance's return, its not your or your child's money that was taken, if was the fiancé's money that was taken.  The money isn't under either of your names, it under your fiance's name since they supported you.  There's nothing for YOU to get back.

If you and your child were claimed as dependents on your fiance's return, its not your or your child's money that was taken, if was the fiancé's money that was taken.  The money isn't under either of your names, it under your fiance's name since they supported you.  There's nothing for YOU to get back.

Do you have any income?  You might need to file your own tax return.  You can only protect your own refund.

Since fiancé claimed her as a dependent, any income she has is minimal.

Get back what money?  You can only get anything back if you personally had tax withholding taken out of your own paychecks.  Sorry but you are the one that is confused.

Its not yours or your sons money.  Its a credit your fiancé got for supporting both of you and claiming you both on his tax return.

If you were married and filed a joint tax return and the refund was taken due to his prior debts you might be able to get a portion of it returned if you lived in a community property state.  But if you had no income for the credit to be computed on, there is nothing to be refunded to you.
