HDHP Lapse-single

My son is single with a HDHP, no HSA and no lapse. I have tried answering the type of HSDP on Dec 1, 2023 with every choice and I still get the lapse issue on the next question. Where am I going wrong?

This is likely a state issue. Without an HSA no HDHP coverage is required for federal purposes. Tell us the state.

To clarify, are you sure there is no code W in Box 12 on his W-2? 

Was the W-2 typed in or uploaded?

No. The code in box 12 is DD. The W2 was uploaded.
