German Holocaust reparations

Question 1

My wife is receiving Holocaust reparations from the German Govt. I asume from what I have heard, these funds are not taxable by the federal govt. or New York State where we live. Even though the funds are not taxable, does she have to list them on the federal form and or the New York State form. Or does she not have to list them at all on the 2 forms?

Question 2

If my wife and I file separately, Does her income go o her and my income to me as far as both our adjusted gross incomes are concerned.

    Per IRS Pub. 525, https://www.irs.gov/pub/irs-pdf/p525.pdf p. 35, Holocaust reparation payments are not reportable and therefore not taxable.  Same would apply to your New York taxes.

     

    If you and your wife file separately, then you will each have your own return and your own AGI (Adjusted Gross Income).  Please see the following link for more information on filing MFS vs. MFJ:

    Hello,

    Holocaust reparations from the German government are not taxable by the federal government or New York State and does not get reported on the tax return.

     

    Since you are filing married separate your income and deductions go on your tax return and your spouses goes on their return
