For form IT-112R can line 24 be greater than imposed tax?

On my NYS return I am getting a message saying the IT-112-R Tax Amount - TP should not be greater than the tax imposed by the other state (NJ).

No, this is correct. Your NY credit is the lower of NJ or NY tax on the same income. You can't receive a credit larger than what you paid.

 

For example: If your NJ tax is $1,000. Your credit to NY is $1,000 or less. It can't be more.

 

Please review your NJ liability and NY entries.

Follow these steps to locate your tax liability for NJ and enter in NY

  1. Log into your return
  2. Select state taxes
  3. Enter the non-resident NJ for which you need the liability
  4. On the left, go to Tax Tools
  5. Select Tools
  6. Select View Tax Summary
  7. You will see Summary of your NJ Return at the top.
  8. Locate the line that says Total Tax
  9. That is the maximum credit for NY
  10. Return to your resident NY return and enter that number where it asks for the liability for NJ. Sometimes the program will do that for you.
  11. Some states tax income the federal does not. For example: NJ taxes money you set aside in your retirement plan. Each state has different rules.

Thank you for your response!  How do I know if line 24 should be lower than imposed tax?  I took the direction to find total tax (on Tax Summary) on NJ state return and now line 24 (on IT-112R) is entered as the same as the imposed tax, but I just want to make sure it shouldn't be lower.  How would i know if it should be lower?  Thanks in advance for your help!

Example: If you are saving pre-tax money into your retirement plan at work, NJ taxes the income while NY does not. This could change the taxable income between the states to affect the tax allowed. On the other hand, NJ does not tax paid family leave while NY does. Each state taxes different types of income and the program should be picking up all the nuances for you.

If the lines match, one is not greater than the other. I wonder if there is a rounding difference. You could drop it $1 to file your return.

Getting the following error

IT-112-R (NJ): Tax Amount should not be greater than the tax imposed by other state
