Filing taxes with spouse living in different states

Hello,

My spouse and I got married in Dec 2022 while I was living and working in MA and he was living and working in TX. In 2022, we filed Federal taxes jointly and state taxes as married filing separate. I moved to Texas in Nov 2023.

For 2023, can I do the same where I file my MA state taxes as married filing separate and Federal as married filing jointly. I am confused since TX is a community property state.

Filing taxes with spouse living in different states

Yes, you can file the same.  The rules in TX do not affect your MA state return. Since your husband was a non resident and has no MA income, you can still file MA separate and file federal jointly.
