Claim of right repayment over $3,000

Hi,

My employer forgot collecting insurance premiums from my paychecks and made me pay it off in monthly installments, which I finished paying November 2019  over a three year period. The amount was more 8 thousand. Can I claim this amount as Claim of right repayment over $3,000" with 2020 taxes?

Claim of right repayment over $3,000

So the insurance premiums were paid by the employer and not you  so they required you to repay them for the expense they incorrectly  incurred.  This is not a "right of claim" repayment situation.  However the insurance premiums you paid with after tax money can be a medical deduction on the Sch A in the year you made the payment.

No, you would claim the amount you paid each year as a deduction in that year.
