The IRS goes by a person's filing status as of December, 31 of the tax year. By you not being married as of December 31, 2016, you will not be able to claim your fiance's daughter as your step daughter for 2016. However, if you are trying to claim her as your dependent, you may want to look at the second IRS test, (Qualified Relative) that I have included below. If the criteria are met and your fiance is not claiming her daughter than you may.
