Can I claim My 58 yr old brother a Disabled Vet? He has been living with us for over 3 years. He doesn't contribute financially would he be considered a dependent?

Likely, yes.  According to Table 5, Publication 501 (extract below) as long as he doesn't have gross income over $4700 for the tax year he would appear to meet the tests to be your dependent.  His gross income does not include any tax exempt income (such as VA benefits).  

 

  • The person can't be your qualifying child or the qualifying child of any other taxpayer.
  • The person either (a) must be related to you in one of the ways listed under Relatives who don't have to live with you, or (b) must live with you all year as a member of your household (and your relationship must not violate local law).
  • The person's gross income for the year must be less than $4,700.
  • You must provide more than half of the person's total support for the year.

In the "My Info" section add a dependent and answer the applicable questions there and TurboTax will help you determine if he meets the dependent criteria.
