Hello
My LLC is registered in New Mexico. My EIN has the NM address
It is an online business so it has no physical address
After selecting a business address I need to select if the address is the same as the physical address.
Should I say yes or no?
So address = the NM address
physical address ??? (my home address)?
Thank you

You said "My EIN has the NM address." What address is that? Your home address?
Are you the only member of the LLC or are there other members? Do all the members live in New Mexico? Why are you using TurboTax Business for an LLC? Is the LLC filing as a partnership, an S corp, or a C corp?
It is a multimember LLC Me and my husband
The LLC was registered NM using a registered agent. I lived in Ca, AZ and now we live in GA.
The EIN has the addressin NM the register agent provided
Yes Using TurboTax business LLC filling as a partnership
Thank you
So you have lived in two community property states, formed a husband-and-wife LLC in a third community property state that you never lived or worked in, using an agent's address, and now live in a common law state (i.e. not community property). I'm guessing that the LLC never engaged in any business activity in the state where it's registered. The husband-and-wife LLC filed for 2020 as a partnership, and you think you might have filed the partnership tax return with the wrong address. I strongly suggest that you visit a tax professional to straighten it all out, and to find out what your filing obligations are for 2021. When you meet with the tax pro, bring copies of the LLC formation documents or partnership agreement, the 2020 Form 1065 partnership return, and your 2020 personal Form 1040 tax return.
I revised my earlier reply to take account of the fact that the only members of the LLC are a husband and wife, that it was established in a community property state, and that at some point you lived in a community property state. This may affect your options for how you file your taxes, but it's a complicated situation. I still recommend that you consult a tax professional to go through all the details.
Please return to the TurboTax Community web site to see my revised reply.
Thank you, Champ
The first 2018 year my CPA prep and filed my taxes. He used the Arizona Address (our personal residency) in the return instead of the one in the EIN in New Mexico.
in 2019 I took over with turbo tax and copied the address used the previous year. So again I used the Arizona personal address.
in 2020 we moved to GA. So our personal address has changed and Turbo Tax is showing the message to check if the business changed address.
I am not sure why the community property state detail matters. Can you explain for me, please?
And as a simple question. WHen filing business taxes for a Multi member LLC partnership should we use the address on the EIN?
Basically, when spouses are the only members of the LLC, in a community property state you have the option to treat the LLC as a disregarded entity instead of as a partnership. But I don't know how that applies when the LLC was established in a community property state, and you lived in a community property state when you established it, but you no longer live in a community property state. The tax professional that you go to will figure it out for you, but they will probably have to do some research because tax professionals in Georgia don't normally have to deal with community property.
I don't know the answer to your question about the address, but if the IRS needs to contact you they will send a notice to the address on the tax return, so it has to be an address where you will have timely access to any mail that is sent there. There is probably a procedure to notify the IRS that the business address of the LLC has changed. Again, the tax professional will be able to advise you about this.
Your situation is beyond the do-it-yourself level. You need to go to a tax professional.
Hello and thanks for your notes
Ok. GA is not a community Prop state.
We live here in GA now but the business is registered in NM. The NM address is the one in the EIN
The company I am using for the NM registrations provided that address and if they get mail they scan it on my account so that I can read it.
I will then for 2021 I will use the NM address in the EIN
Turbo Tax Business has a step where I am asked in name and address was the same as last year. I must report a change of address using form 8822B. Ok
So I will use form 8822B to report the change of address (which now will match the address in the EIN form)
Any mail will be sent there and I will get a scan
I don't have a CPA. I am moving to TT to do this myself and hope I can use this forum for help when needed.
