In 2016, I had to stop paying our credit cards due to wife cancer and then on hospice. I had an attorney write letters about not being able to pay b/c of my wife's pending death. creditors stopped mailing me the bill. So I thought everything was taken care of. I contacted my attorney and she did not keep the records after 7 years. My wife opened credit cards to pay for a lot of medical expenses (some I was not even aware of and they were issued in my name). 7 year she fought stage 4 cancer and lost the battle in Feb 2017. All creditor are coming for these debts now. Pennsylvania has 4 year statue. since the last payment were in 2016, creditor should have issued 1099-c in 2020 or at the latest of 2021. I received 1099C for 2022, 2023 and 2024 all were mailed 2024 year from IRS. Some of these debts were sold to collection agencies and when they call me they didn't even know my SS#. So, I would not provide this information. IRS even added my current wife to this debt because we file joint. Please advise if you have any suggestions.

There is information in the instructions for Form 982. You may be able to exclude debt for a nonbusiness debt (other than qualified principal residence indebtedness, such as a car loan or credit card debt). This will help you to get started, however it would be wise to contact a tax professional to really get the action started.
If bankruptcy is a factor for any year that could create some additional support for your claim to eliminate some of your cancelled debt.
Due to the timeframe and nature of your cancelled debt, it may even be in your best interest to find a tax attorney or a CPA who specializes in income tax.
We are sorry for your medical hardship for your wife.
