I'm the injured spouse. For the most part (11 months) I've been a sahm, I made less than $1000 this year. My husband is the provider with all income but owes on child support. We have 4 kids. With his income we would get the EIC and Child tax credit. With filing 8379, would the credits get allotted to me or do we lose everything since its his income?

The injured spouse form will get you just a wee bit of refund due to your low income... the lion share belongs to your husband so they will keep it.
If my husband is the injured spouse. He is the sole provider, I did not work at all. filing jointly allowed us to qualify for EIC and CTC. However if we filed separately, he would have owed taxes, so if we file the injured spouse form, will he lose those credits and then owe taxes?
