Paid an Excess Advanced Premium Tax Credit in 2020

Hello,

 

On my 2020 Federal Taxes, I paid an Excess APTC and filed my taxes electronically using TurboTax Premier Online prior to the American Rescue Plan of 2021 being implemented.  To date, I've still not received a refund of that payment.

 

Is there a way to recoup that payment when filing my 2021 Federal Taxes on TurboTax Premier Online?

Paid an Excess Advanced Premium Tax Credit in 2020

No, there's no way to recoup your 2020 excess advanced Premium Tax Credit on your 2021 income tax return.

  • Per IRS: If you already filed a 2020 return and reported excess APTC or made an excess APTC repayment, you don't need to file an amended return or take any other action. The IRS will reduce the excess APTC repayment amount to zero with no further action needed by the taxpayer.
  • The IRS will reimburse people who have already repaid any excess APTC on their 2020 tax return.
  • Taxpayers who received a letter about a missing Form 8962 for tax year 2020 should disregard the letter if they have excess APTC for 2020. The IRS will process tax returns without Form 8962 for tax year 2020 by reducing the excess APTC repayment amount to zero.

Unfortunately, I am very aware of the official statement from the IRS regarding them reimbursing people who have already repaid any excess APTC on their 2020 tax return.  However, I have still not been reimbursed and the IRS also makes it clear NOT to send an amended return for 2020 to recoup that repayment.  Heck, I'm still waiting for them to process a 2019 Amended Return from me that they received on 04/30/2021!!

 

I was hoping that because of the IRS backlog, that they would have a way to recoup the repayment when filing the 2021 Federal Return.

Paid an Excess Advanced Premium Tax Credit in 2020

Although you can't enter anything on your 2021 tax return to account for the back taxes that are owed to you, since you have effectively a credit balance on your account with the IRS for that amount of money, you could not pay in taxes owed in for 2021 in the hopes that the IRS will apply your credits with the tax you owe and refund the balance.

 

This could be perilous, however, since the IRS could assess penalties for late payment of tax, as they would likely not allow the previous year credits as an excuse to not pay your current year tax liability.
