Medical expenses from car accident settlement

I was involved in a car accident late last year. As a result of that accident I have st least $40k in medical expenses this year but those expenses has been billed to my attorney who will then deduct that amount from my overall settlement. Would I be able to claim that type of medical expense in my tax return

Only out of pocket un-reimbursed medical expenses that you paid can be deducted as an itemized deduction on Schedule A
