Department of child services got involved with my kids and they were placed in foster home and custody is now mine. The foster family was told they were not to claim my children at all after they were returned home and that any copies they were given by dcs of important documents were to be shredded after my children came home to me. My tax return was rejected because the foster family claimed them as dependents despite being told by DCS aka a federal office not to do so as they are now home. Is there anything I can do?

You will have to print, sign and mail your tax return that claims your children as dependents. Their Social Security numbers have been put into the system already so you will not be able to e-file. Mail in your return; the IRS will sort out the duplicate use of the SSN's. It will take longer for your return to be processed, so expect a wait. Use a mailing service so you will know the IRS received your return.
When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s. Use a mailing service that will track it, such as UPS or certified mail so you will know the IRS/state received the return.
Federal and state returns must be in separate envelopes and they are mailed to different addresses. Read the mailing instructions that print with your tax return carefully so you mail them to the right addresses.
