@CaptdennismRN And.....not sure if you read this whole thread but it is very old and it began before the tax laws changed. Even if you are seeing posts dated "2019" they are really older. When the user forum changed from Answer Xchange to Real Money Talk in mid-2019, a lot of old threads migrated over with 2019 dates. The information is old and outdated. Tax laws changed for 2018 and beyond with the Tax Cuts and Jobs Act. There are a lot of job-related expenses that can no longer be deducted on federal returns if you are a W-2 employee.
Q. Is Per Diem for 13 weeks deductible?
A. Simple answer: No.
Under current (2018+) rules, expense allowances/per diem are included in a W-2 employee's gross pay and the expenses paid are not deductible. Expenses paid under an "accountable plan" (reimbursement for actual expenses documented by expense reports) are not included in the employee's gross income and are deductible by the employer (not the employee)
But, it depends on the details of the situation. Are you W-2 employee or a self employed person/contract employee. Is the per diem included in box 1 of your W-2 or 1099-NEC.
