Can you make above-the-line deduction for attorneys fees/court costs paid in 2018 relating to lawsuit for unpaid wages and/or bonuses? Lawsuit still ongoing as of 2019.

I know you can make above the line deductions for employment discrimination cases, but I thought at one point ATL deductions could be made for my situation as well.
