1095-A for a dependent

We supported our son for all of 2022.  He had no income at all, but received a 1095-A.  If we list him as a dependent on our taxes, will they look at our income and therefore we would be penalized and owe the premium back?  Or am I not listing something correctly so that it does not look at our income.

1095-A for a dependent

Yes, at 35, the only benefit would be a $500 Other Dependent Credit on your return.  The repayment of the Premium Tax Credit would negate any benefits of the Other Dependent Credit if you fall outside the income criteria for claiming the credit.

Yes, if you list him on your taxes you will need to include the 1095-A and the premium tax credit will be based on your income instead of his.  Depending on your income, you  may have to pay back a portion of the premium tax credit.

 

How old is your son?  Is he a student?

He is not a student.  Age 35 and was just unemployed in 2022 so lived with us for the year.  It sounds like he should file himself, even at no income, so that it looks only at his income.  Then we would obviously not list him as a dependent and not risk having to pay back any of the premium credit.
