How to file state tax if I worked for a company in Massachusetts remotely and lived in Texas

Hello,

I started working for a company in Boston since August 2020 while I was living in Texas until the end of 2020. My company advised me that I am eligible for double taxation and I should claim a refund for the tax I paid in the state of Massachusetts as i was not living there. 

I moved to Mass. since Jan 2021 and the generated W2 for the tax year of 2020 shows my Mass. address and does not show any residency info in Texas. I appreciate it if you could let me know what is the procedure for filing my state taxes and if i need to ask the company to re-generate a new W2 form with a revised address.

Your income in 2020 is sourced in Texas as you worked from your home in Texas. Texas has no state tax. If you had tax withheld in MA, you should file a non-resident 2020 MA state return to claim a refund of taxes withheld. It is not important that your 2020 W-2 bears your MA address as you can prove that you only moved to MA in 2021.

You don't need a new W2.  The address on your W2 has no effect on your taxes.  Just enter your current address in the Mailing Address section of My Info.

 

If you lived in TX all of 2020, and you never physically worked in MA, your income is not taxable by MA.  But if your employer mistakenly withheld MA taxes, you'll have to file a non-resident MA tax return, allocating zero income to MA, in order to get those taxes refunded.

 

MA does not tax non-resident remote workers unless they temporarily relocated from a MA work location to a remote work location because of the Covid pandemic.
