Florida Resident, Live in Maryland, Work in Virginia (remote)

I can't seem to find an answer anywhere and I've even sat the hold for almost an hour to ask the Maryland Comptroller office...

 

We are an active duty military family and live in Maryland but are legal residents of Florida. However, I work remote and the company I work for is in Virginia. No one seems to know which form(s) I need to fill out. Florida doesn't have an income tax and thus, no tax form to submit to my employer. 

 

Do I need to submit both the Virginia VA-4 (Non-Resident State) and Maryland MD MW507 (Non-Resident State)? If I submit the MW507 form, will taxes be withheld and will I get them back at a later time?

 

Our taxes are always such a headache.

I understand that you are an active duty military family and your home of record is Florida. 

  • All military related income is only accountable to Florida regardless of anything else.
  • The fact that the company you work for is based in Virginia is of no consequence.  What does mater is what state you were in when you earned the money.
  • Finally,  if your remote job was a non-military activity, then that income would be taxable in Maryland as a Non-resident.

I'm not sure how to answer your last question about getting a refund.  If you paid taxes to Virginia, that was wrong and you would have to file a tax return to get it back.  If you paid taxes to Maryland it would depend on how your return worked out.

You submit form MW507 and fill out line 5 (certification of military status).

State Taxes will not be withheld.  if they accidentally are, you will have to file a MD return to get a refund.

 

As a military spouse, you are exempt from MD tax. As the other reply said, VA is not relevant. Reference:  https://ttlc.intuit.com/questions/1901516-military-spouses-and-state-taxes
