I know that working in WV and living in MD involves being taxed only in MD BUT do I still have to file a tax return in WV?

    No. You do not have to file a West Virginia tax return if you live in Maryland and your only WV income comes from your job — unless your employer withheld WV tax by mistake.

     

    WV and MD have reciprocity, meaning a WV employer reports W-2 income earned in WV as MD income and withholds MD state tax.

     

    If WV tax was withheld by mistake, file a WV return to claim a refund and fill out Form WV IT-104NR West Virginia Certificate of Nonresident to stop further WV withholding.
