Daughter - a Student earned money at during school out of state

My daughter attends school and stayed the summer of 2021 in Chicago, IL.  We live in OH. She earned income both at a summer job and a work study job during the year.  She did not earn money in OH during 2021.  We used our OH address as her residence address to fill out tax forms even though her W-2's are from IL.  Do I need fill out a state tax form for both OH and IL?  Are there some tax implications to the work study job since it did not have Federal tax withheld, but did have IL tax withheld?

 

A preliminary pass shows that she owes money to IL, but that doesn't seem quite right.

 

Any help would be appreciated.

Yes, you will need to fill out two state returns for your daughter. Since her resident address is in Ohio, you would want to fill out a nonresident return for IL and a resident tax return for her in Ohio.

 

After completing the federal return, you will want to first do the Illinois return. Make sure that all her W-2 wages are correctly apportioned to Illinois. After completing that, you will fill out her Ohio return which should contain a credit for the taxes paid to Illinois. 

 

As for whether or not she should owe a small amount to Illinois, that would depend on how much she was paid and how much state taxes were withheld. As a dependent, she does not receive any exemption in Illinois if she earned above $2,375, and it is quite possible that her jobs withheld too little because of that. 

 

Her work-study job is still taxable income, both federally and by state. Oftentimes, if the job is only held for a short period of time, federal taxes are not withheld due to calculations based on how your daughter filled out her W-4 and the greater deduction amount for dependents on the federal return.
