Confusion on residency of 2 states with TurboTax overwriting my entries

I am still confused on how to fill some of the fields in Turbo Tax to reflect below. I request your help specifically to please confirm the TurboTax entries accordingly.

 

Context:

  • California: I was born in California and have been living there until end of 2023 in my parent's house which is also my mailing address. My driving license, voting, parent's/mailing address and bank accounts are in CA. I filed my taxes in CA in 2023.

 

  • New York:  I rented an apartment in New York from Nov 2023 where I lived for all of 2024 including Dec 31st, 2024.  I visited my parent's house in CA only for few days now and then may be max. 20 days. I work remotely in NY and plan to move back to CA to my parents end around October of this year.

 

I downloaded both New York and California state for TurboTax. Please confirm if below look ok or if I should change anything.

 

Questions:

 

1)  Should I mark No for "Were you a California nonresident during all of 2024?" ( though I stayed only in New York throughout 2024 including December 31st of 2024? )

2) I understand that I am considered domiciled in California. Am I right?

3) I visited my parents multiple times in 2024, stayed in their house.. approximately for a total of 60 days.

6) Though I changed the entry to No in step 1, when I come back to it, TurboTax changes my entry back to Yes for that and fills the form as non-resident. Please advise what I a missing.

No, unless you are a dependent student and only temporarily in New York, you are a non-resident of California. 

I understand that you have not updated your driver's license and Voter's registration card, but that does make you domiciled in California. 

 

You are domiciled and a full-year resident of New York for tax year 2024.

 

According to the state of California:

"Domicile is defined for tax purposes as the place where you voluntarily establish yourself and family, not merely for a special or limited purpose, but with a present intention of making it your true, fixed, permanent home and principal establishment. It is the place where, whenever you are absent, you intend to return. The maintenance of a marital abode in California is a significant factor in establishing domicile in California.

Change of Domicile

You can have only one domicile at a time. Once you acquire a domicile, you retain that domicile until you acquire another.

A change of domicile requires all of the following:

• Abandonment of your prior domicile.

• Physically moving to and residing in the new locality.

• Intent to remain in the new locality permanently or indefinitely as demonstrated by your actions."
