remote work

Hello,

I live in Virginia and was hired as an independent contractor by a company in Georgia.  I work from home in VA and provide remote telehealth services to people in Montana. I am paid by the company in Georgia who mailed me a 1099-NEC.  Do I file state taxes with Montana or Georgia? Thank you for your help

You might need to file a Georgia state return in addition to Virginia. 

Montana has no bearing on your situation. 


According to the State of Georgia:

 

"If you are a legal resident of another state, you are not required to file a Georgia income tax return if:

  • Your only activity for financial gain or profit in Georgia consists of performing services in Georgia for an employer as an employee 
  • The compensation for services performed does not exceed the lesser of five percent of the wages in all places or $5,000.00"
