My father died in 2016. I am the executor of his estate. I filed his 2016 taxes with TurboTax, but had not planned to file 2017 taxes because his estate had no income, but I just received a 1099-C from one of his debtors for $27K. I tried to create a 2017 tax return, but TurboTax will not allow me to do so because he died in 2016. The estate does not have any money, but he does have a piece of property that we are trying to sell to pay he remaining debt. The probate is still open. What am I required to do?
You'll need to sign in or create an account to connect with an expert.
You will need to file an IRS form 982. The form indicates that your father was insolvent prior to the cancellation of debt, therefore the 1095-C income is excluded from taxation.
