Question

Newly Divorced

Hi, I am newly divorced after 51 years. No dependents. What do I need to do differently? Do I need to submit divorce documents for proof? Or do I simply delete him and use my current account to file my personal documents. He only had social security. No retirement or other income from him. I work and will be receiving my WW2 and my social security document.

For your federal taxes, you do not need to submit physical divorce documents to the IRS as proof. When you file, you will simply select Single as your filing status (assuming you were divorced by December 31 of the tax year).

    • Since the ex-spouse only receives Social Security and is no longer a joint filer, his income is completely excluded from your return.

    • You must  report your Form W-2 wages and Form SSA-1099 (Social Security).

    • You should submit an updated Form W-4 to employer to adjust federal withholding to the "Single" rate.

You can continue using your existing TurboTax account; you do not need to create a new account but must update your Personal Info profile. Clear the Spouse Information block so no SSN or name remains in the secondary filer fields.
