Here are the details: -Spouse passed away in 2021. -Primary residence was purchased in 1996. -Primary residence was sold in 2025 (4 years after death). -House was primary residence for both the entire time. -FMV of the house day of death was $700,000. This is an estimate based on what other same track homes sold within a month or two of the date of death. No appraisal was done. -We lived in a community property state (CA), hence there was a step up basis of the entire value. -The house sold for $940,000 (before expenses). -I MIGHT receive a 1099-S, but I'm still not sure about that. My questions are: 1.) If I do not receive a 1099-S, do I still need to do Form 8949 since the gain is less than $250,000 and it was a primary residence? 2.) On Form 8949, "date acquired", do I put the 1996 date or the 2021 date since there was a step up in basis? 3.) Do I need to put any codes in (f), and do I need to put an amount in (g)? 4.) Do I need to get a date of death appraisal done of the house? Thank you for you help, and feel free to correct me if any of my assumptions are incorrect.

Another family member is living there who is also not the legal owner. But we pay every expense associated with the home. Mortgage, taxes, insurance, repairs, and every single utility bill. The home is listed as "estate of" until we complete probate but we have personally been paying for everything since the family member/owner passed over a year ago.

If your child was born in 2025 make sure you said he lived with you the whole year. There is an oddly worded question that asks if the child paid over half their own support. Say NO to that question.
Have you entered income from working in 2025? If not, you will not receive an income tax refund based on having dependent children.
The maximum amount of the child tax credit is now $2200 per child; the refundable “additional child tax credit” amount is $1700. In order to get that credit, you have to have income from working.
Take the amount you earned from working. Subtract $2500. Multiply the rest by 15%. That is the additional child tax credit per child that you can get—- up to the maximum of $1700 per child. If the amount you earned from working was low, you will not get the full $1700 per child.
If your child is older than 16 at the end of 2025, you do not get the CTC. But you may still get the non-refundable $500 credit for other dependents instead.
