"The $800 earnings will be taxable plus 10% penalty if you are under age 59-1/2. " Almost certainly not. There will likely be no penalty because the distribution of the $800 will almost certainly be from Roth IRA contribution basis acquired from the permissible contributions made for earlier years. Because the distribution does not qualify as a return of contribution before the due date of the 2024 tax return, there was no requirement to distribute attributable earnings. Only the $3,000 needed to be distributed as an ordinary distribution. Since the distribution occurred less than 60 days ago, you have the option to roll back to a Roth IRA the $800 distributed unnecessarily (although the financial institution from which the distribution was made might disallow the rollover if they believe that the rollover is a portion of the distribution that they believe qualified as a return of contribution before the due date of the tax return.)

The IRS sent a letter stating that "retirement income taxable" from the form 1099-R was missing from our 2023 tax return; however, we reported the amount shown in the 1099-R and also selected in turbo tax that the entire balance in the traditional IRA was converted to a Roth IRA within the 2023 tax year. Our 2023 tax return also shows this amount. The IRS is trying to tax us on the balance in the 1099-R, but given the conversion to the Roth, we should not owe any taxes. My spouse also reported the same in our tax return, and there were no issues raised for their account.

Hi Fanfare Level 15! Thanks for the detailed repones! I appreciate the time and care in answering my question. I used Turbo Tax to amend my return. In particular, I update section Tradition and IRA contribution under " Deductions and Credits" . Turbo Tax generates 1040X and form 8606 and I e-filed these forms successfully.

Tax software is a very "sticky" purchase, once you make the move to a competitor and invest in that learning curve, you are almost impossible to get back.

Don't have a work permit yet and likely won't looks like him liable for taxes though because of how long I'm gonna be in the country however They have their own form of a standard deduction which I should be well under. I think I found everything I need on not able to renounce my American citizenship yet it's gonna be a long time until I can

In TurboTax Online there is no way to save a PDF of a single form. You could use a PDF editor to extract a single form from the PDF of the entire return. With a little web searching I think you will be able to find a free PDF editor.
In the desktop TurboTax software, the Print Center gives has an option to save a single form as a PDF.

(a) Are you a US person ( citizen/GreenCard / Resident for Tax Purposes )? From your post it appears that you were/is a Resident for Tax Purposes --true ?
(b) If you are a GreenCard or Resident for Tax purposes , how long were you in the US -- this is because , long-term US persons need exit/ sailing permit.
(c) Which country are you in now ? From your post it sounds like you are not a citizen of that country.
(d) Residency is determined for each year based on SPT ( if not GreenCard ).
Note NRAs with US sourced income generally are not able to claim standard deduction and you essentially file as single ( single or otherwise ).
Please answer the questions above --yes ?

Whatever instructions you find, keep a couple of things in mind.
(a) You are no longer starting from the beginning. There have been a few actions taken, by you, your spouse, and the IRS, that complicate the situation. I don't think you are going to find any instructions for what to do at this point.
(b) Your wife's options may be limited by the fact that it is now after the due date of the return. You cannot change from MFJ to MFS after the due date of the return.
Also, in your original question you said that the IRS letter asks for "verification such as divorce decree." That doesn't make sense. You would not need a divorce decree to file as married filing separately. In fact, a divorce (before the end of the tax year) would prevent filing as MFS. So there must be some kind of mistake or misunderstanding somewhere in the chain of events.
All these complications are why I think you need to get a tax professional to straighten out the mess that you are now in. This is no longer a do-it-yourself project.

Totally agree. I believe millions of current user will be leaving TurboTax for this reason. I cannot believe a company such as Intuit, is not capable of writing code that protect the security of its users. Hire some real programmers, or use AI or grow a spine. I agree with the original poster that TurboTax has become less user friendly and not as progressive as it should be (it's 2025!!). I also have been a user since the late 20th century, but now I will be looking for other companies to do business with.

Intuit is wrong when they state in their email sent today, "Microsoft will no longer provide ... security fixes for Windows 10 operating system. Because security is a top priority for us, TurboTax Desktop software for tax year 2025 onwards will not be compatible with Windows 10 operating system." In fact MS's Extended Security Updates (ESU) program for Win10 "provides access to critical and important security updates as defined by the Microsoft Security Response Center (MSRC) for devices running Windows 10, version 22H2." (support dot microsoft dot com/en-us/windows/windows-10-consumer-extended-security-updates-esu-program-33e17de9-36b3-43bb-874d-6c53d2e4bf42) "You can enroll in ESU by one of the following three ways: At no additional cost if you are syncing your PC Settings Redeem 1,000 Microsoft Rewards points One-time purchase of $30 USD or local currency equivalent plus applicable tax All enrollment options provide extended security updates through October 13, 2026."
