A self-employed transportation worker may claim the per diem expense. A transportation worker who receives a W-2 may not claim the expense.

This TurboTax Help states:

Truck drivers can claim tax deductions for expenses incurred on the road, including tools and equipment, association dues, and meals while working away from home overnight.
Only self-employed truck drivers can claim tax deductions on their federal tax return for job-related expenses, while those who receive a W-2 from a trucking company typically cannot.
