The American Opportunity Tax Credit Eligibility_2

I obtained a four-year bachelor's degree from a foreign country and began college in this state last year. The college requested an evaluated transcript from my institution in my home country.

Although my foreign college appears ineligible according to Institution 529 (as verified on the website below), since I submitted the evaluated transcript for my application and in FAFSA, am I still eligible to claim the American Opportunity Tax Credit?

The American Opportunity Tax Credit Eligibility_2

No.  If you have a bachelors degree, then you are not eligible for the AOTC.  however, you may still be eligible for the Lifetime Learning Credit.

 

The exact wording is, "Available ONLY if the student had not completed the first 4 years of postsecondary education before 2024 (generally, the freshman through senior years, determined by the eligible educational institution, not including academic credit awarded solely because of the student's performance on proficiency examinations"  Pub 970

 Q. Since I submitted the evaluated transcript for my application and in FAFSA, am I still eligible to claim the American Opportunity Tax Credit?

A. It depends on the results of that "submittal".  What ever your new school is giving you credit for counts, for AOTC eligibility,  as post secondary work that you have completed.
