Unfortunately no. The credit goes with the dependent. A non custodial parent can't claim the deduction.
However, you are eligible to claim the Education Credit if you (or your dependent or a third party) paid qualified education expenses for higher education.
The dependent has not earned enough to file a tax return. So, in that case, no one will claim the 1098-T tuition payment?
If that is the case, the custodial parent can still claim the student as a dependent?
Yes. The custodial parent claims the dependent child's Education Credit.
