Recovery Rebate

My daughter is 16 and works part time, she decided to do her taxes on her own without telling me, it was suggested by turbo tax that she claim the recovery rebate which she did and she filed her taxes, everything was accepted and she got a decent return. My concern is that she is not eligible to have that rebate since I claim her as a dependent on my own taxes. Do we need to amend her return?

Yes, you do have to amend it.   She is a dependent.   Dependents are not eligible for the 3rd EIP payment so if she received that $1400 EIP payment she has to pay it back.   And...since she already filed and used her SSN you are not going to be able to e-file.  You can claim her as your dependent but you have to file by mail now.   You are going to want to receive the child tax credit for claiming her.   And if you have not already received your $1400 for claiming her you will want to receive that on your own tax return.

Your child made a common mistake.  Kids do not understand the significance of saying they can be claimed as a dependent.   They need supervision and guidance for the first tax return they prepare and file.

You do not need to wait to mail your own return.   Her amended return will take months to process.   The SSN will never catch up in the system in time for you to e-file this year.  Sorry.

I e-filed a month before she did so mine went through already so I'm surprised hers was accepted. But I will definitely get started on amending them.

Better check your return and hers to see if the ssn are the same.  Maybe one is wrong if both returns got accepted.

I went through everything, I figured out what she did wrong and was able to correct it and file the amendment to give that money back, thanks for everyone's help!
