If the only thing that was changed on the W-2 is the amount of Social Security wages, Social Security taxes withheld, Medicare wages or Medicare taxes withheld, then you do not need to amend the 2018 tax return.
Thanks for your help!
I see... so do I just need to claim by sending to IRS forms 843 and 8316?
I am reading a lot online and getting so confused.
Thanks again!
Your employer should refund the amount paid. If not and you are not a US citizen or US resident alien then you will need to file either 843 or if eligible Form 8316.
IRS Form 843 - https://www.irs.gov/forms-pubs/about-form-843
IRS Form 8316 - https://www.irs.gov/pub/irs-pdf/f8316.pdf

Got it. No they did not refund me but they gave me an updated w2-c to submit. I will have to fill those forms I guess. thanks for your help and the additional links!
If any one employer withheld too much social security, Tier 1 RRTA tax, or Tier 2 RRTA tax, you can't claim the excess as a credit against your income tax. Your employer should adjust the excess for you. If the employer doesn't adjust the overcollection, you can use Form 843, Claim for Refund and Request for Abatement to claim a refund.
I am in a similar situation. I'm a student on an F-1 visa. My employer has agreed to refund my 2019 FICA taxes. I have been given a W-2c but I have already filed my federal tax with the previous W-2. Do I need to amend my tax return?
I have read varying replies on here, any help is appreciated!
