If this box in your 1040 form is checked then you are not eligible.  The question is "can" you be claimed - whether you are actually claimed of not.

 

This is what the IRS says:

A1.  You may be eligible to receive a Payment if you:

  • Are a U.S. citizen, permanent resident or qualifying resident alien;
  • Cannot be claimed as a dependent on someone else’s return;
  • Have a Social Security number (SSN) that is valid for employment (valid SSN); and
    • Exception: If either spouse is a member of the U.S. Armed Forces at any time during the taxable year, then only one spouse needs to have a valid SSN
  • Have adjusted gross income below an amount based on your filing status and the number of your qualifying children.

so basically that Tweet from @TurboTax Support is wrong? 

because we see too many contradicting answers.

 

it doesnt make sense that the question "can you be claimed" = YES would result in not receiving a stimulus check --- even if you make too much money and was not even eligible to be claimed.

That is the IRS answer right from the IRS and I posted the reference link.

And that is how Congress wrote the law.

 

Now you are asking a different question.  For that box to be checked, you must answer the question that you *can* be claimed.    If you are not eligible to be claimed, then you should not have checked that box, and if you checked it in error then submitting a mailed amended return with the box unchecked it the only remedy.

 



If you filed, it is like dropping it into the mail - you cannot get it back if accepted by the IRS or state.

To amend your 2019 tax return:

-- First, *wait* to see if your return has been accepted or rejected by the IRS or state. DO NOT do anything until you receive the accept or reject e-mail.

-- If rejected, you can correct and re-send your return.

-- If accepted you should *wait* until your return has been processed and you receive your refund or conformation that any tax due has been paid. (If you file an amended return while you first return is being processed it can cause extended delays for both returns if two returns are in the system at the same time). In addition, if the IRS makes any change on your original return, you might end up having to amend the amendment – a sticky process that can take a year or more).

-- Then you can start the amend process.

-- Amended returns can only be mailed - allow 8-12 weeks - can take up to 16 weeks (4 months) for processing.

Amended returns can take up to 16 weeks (4 months) to process in normal times but due the the Corona virus shutdown the IRS is not even opening mailed returns at this time and just storing them so the 16 weeks will not even start until the IRS returns to normal - whenever that will be - and there will be a huge backup of mail.
