While filing a married filing jointly my husband has a 3 month gap in coverage (Oct - Nov) due to switching jobs. He did not take ACA coverage. The e-file is rejected with the error - F8962-070 - The e-File database indicates that Form 8962 or a binary attachment with description containing "ACA Explanation" must be present in the return. It looks like Turbo tax assumes you have coverage for the gap via ACA. What forms or where/what in turbo tax do I denote there is a true gap so the e-file will be successful.
Thanks - S

It probably has nothing to do with your husband's gap in coverage, but the IRS believes you or someone on your return received health insurance through the marketplace in 2021. This may be the case if anyone is listed as a covered individual on a marketplace insurance policy, even if the main individual is not on your tax return. If anyone in your family has an account on Healthcare.gov, they will want to check to verify there is no 1095-A for 2021. If no one in your family was covered by marketplace insurance at any point in 2021, this workaround has worked for some:
Entering $1 for your January premium will not impact your return and it should get past the IRS automatically rejecting it for not having the marketplace forms attached to your return.

RaifH - Thanks so much . The workaround worked and the taxes were 'accepted' via the E-file. I was doing the taxes for my daughter and her husband and wrote the question from her viewpoint 🙂 Scott
