Hardship

Me and my significant other file taxes together we have two kids in common so he filed for all of us cuz he's the only one that can file cuz I'm on Social Security. My question is I'm homeless with the kids and he's staying at his parents and he owes back child support so they took all of his taxes. Is there any way that I can get any of the child tax credit or earned income tax credit that should go to the kids to go to the kids. And in that case is there anyway I can get the money that is owed to my two little ones to go to my two little ones out of the stimulus package.

Hardship

Well---the two of you have made some mistakes starting with "we file taxes together."  If you are not legally married you cannot file a joint return.  Did you do that?  Or did your BF claim you as a dependent on his tax return---that makes a big difference.    

 

If your income is Social Security, no, you cannot get child tax credit or any other child-related credits because those credits are based on income earned from working.  

 

If your BF is the father of the two children then he can claim them as his dependents--it is unfortunate that his delinquent child support causes his refunds to be seized, but that is how it works.  The money that was seized is not your children's' money although you want to think of it that way.  

 

A person who owes back child support will not receive a stimulus check.

He claimed me and kids ok so question when it comes to the stimulus can't I get the stimulus money go towards the kids because the reason I'm asking is there really is a hardship because I am homeless and I'm just trying to take care of my kids I'm trying to get into a place when no one wants to give me any help to get into a place because I don't have the best credit
