Hi .my son's father who lived with me in my house solely in .y name pulled a fast one on cash app or some site and claimed our son who was 12 at the time and also lived with us before I had the chance to.So then I went to HR Block and they told me my son's number had been used so I thought someone hacked him..I went home told his father and after a week he confessed he did put Myles out son as his dependent how could he do that he didn't work..don't know if he got money or not but I just amended my return they received it..side note his dad and I were never married and how do you get a child care credit without working .I also filed head of household that year completed the amendment with an accountant mailed it in and checked the website they received it 10/25/24. I included an explanation letter and his school records. The accountant calculated that if all goes well I should get back about 6000$ will his dad get in trouble...it really worked my soul that he would do that to me when he knew I always filed..what can I expect

Tax year 2021 was the one and only tax year in which a parent could claim a child on a tax return and get the child tax credit even if they had no income from working---so it sounds like your "ex" exploited that. However, if you were the one who was working and supporting the child, then you were the parent who could claim the child as a dependent. Filing your own 2021 return claiming the child was the "okay" thing to do; eventually the IRS will process the return and you should be the one who receives the child-related credits for claiming your son. Your "ex"-- who filed improperly and should not have claimed the child, will face repayment of the credit he received and may face penalties as well. Your BF likely received at least $3000 when he claimed your child.
Do not expect quick results from amending. It can take four months or more for the IRS to process an amended return.
