I need ITIN to claim tax treaty benefits (option A in W-7 form), but my application was rejected.
I have an agent (do not trust her, but already paid her), who claims, that only way to get ITIN is that I need to fill option B (filing a US federal tax return).
My question is - if I check box B (filing a US federal tax return), do I have to file a US federal tax return, or not?

If you check box b on Form W-7, you do not have to file a tax return if you do not meet the requirements to file. Checking box b does not force you to file a tax return. Were you given a reason why your application was rejected? Post a reply to this thread if you need additional help.

Reason it was rejected was that there were some documents missing - specificaly signed form 1042-S. I have income from microstock platforms (such as shuttesterstock) and apparently I may need ITIN to claim tax treaty benefits. Shutterstock provides 1042-S form, but only digitally (not signed) and IRS rejected it, becase they want it signed.
