TurboTax wants to add my CommonLaw partner's information under my name, it won't add under his name. Should we continue or file seperately?

It depends.

It sounds as if you are writing over information that has already been entered in the account you are using. If you are using TurboTax Online, that product is designed to file one tax return per user account. If you would like to be able to purchase one product to prepare up to 5 tax returns, you would need a TurboTax Desktop product.

To file your own return in TurboTax Online, you would need to set up a separate account for yourself. See here to get started.

If you are not considered legally married in your state, you can't file a joint return. Common law marriages are recognized for federal income tax purposes only if they are recognized by the state in which the taxpayers reside. See this TurboTax tips article for more information.
