Turbo tax calculated that my daughter receives a sales tax refund of $800 in Colorado with no income? She only had dividend income of $11 in stocks on her fed return?

She was a fulltime student and didn't work in 2023.  On the Colorado return -$1239 (negative) of income carried over from the Fed return and is reported on the State Return because on the  Fed return it uses $1250 for earned income if you have less than $850.   It just doesn't seem legit that she get an $800 refund from the State of Colorado, but the error check in Turbo tax all comes back clear.

Based on what you describe, your daughter would appear to be eligible for the $800 TABOR credit.

 

According to the Colorado Department of Revenue's Taxpayer's Bill of Rights (TABOR) Information page, a Colorado resident can claim the credit if they:

  • File a 2023 DR 0104 by April 15, 2024, if you: 
    • Were at least 18 years old when the tax year began, 
    • Do not have a Colorado income tax liability,
    • Are not claiming a refund of wage withholding, and
    • Are not otherwise required to file a Colorado return because you have no federal filing requirement.
  • File a 2023 DR 0104 by October 15, 2024, if you: 
    • Have a Colorado income tax liability,
    • Claim a refund of wage withholding, or
    • Are required to file a Colorado return because you are required to file a federal return.

 Note that your daughter will have to file her state return by April 15th.
