The IRS rejected my 2020 baby for the recovery rebate, but accepted her for my child tax credit.

Here is an update.

 

I got a hold of someone about a month back who I was able to convince the recovery rebate credit was based on 2020 tax information.  He said he couldn't process the information himself and would have to write a referral.  The referral  was not approved.   I now have a letter from the IRS concerning the recovery rebate tax credit that states:

 

"We reviewed your tax return and believe that our original change to your tax was correct.  EIP-1 is based on tax year filed2019 (or 2018).  EIP2 is based on tax year filed 2019.  EIP3 is based on tax year filed 2020 (or 2019).  Since your child was born in 2020 the child would only qualify for EIP3.  Therefore, you were not allowed EIP1-2 for your child." sic

 

They are confused about the tax year used for the initial payouts of EIP versus the RRTC using tax year 2020.  I have called and connected with someone once to talk to them about it.  They wouldn't listen to a word I would say and just direct me to a letter.  Despite directing them to the irs' own website:

 

Recovery Rebate Credit — Topic B: Eligibility | Internal Revenue Service (irs.gov)

 

"A1. The eligibility requirements are the same for the Recovery Rebate Credit as they were for the Economic Impact Payments except that the credit eligibility and the credit amount are based on your 2020 tax year information. The Economic Impact Payments were based on your 2018 or 2019 tax year information."

 

I am going to try a couple more times and then contact my congressman or try alternative avenues.

 

In the IRS Child Tax Credit portal it states "Eligibility Status Pending, your eligibility has not been determined. You will not receive advance payments at this time."  Which is pretty funny, since I have received the child tax credit for like the last decade.   I think it is likely if you had issues close to the start of the program, then its likely you're not getting on it for the rest of the year.

Just saw this today. I have yet to recieve any of my child tax credit payments. My eligibility has been pending due to amended return I have been told.

Last week I called a tax advocate to see if they could help me. Since I filed my amended return on 4/21 and I have not received the refund and it has held up my advance child tax credit. It also says that the amended return was completed in September if I look it up. So after 5 hours on the phone she found that it was never closed out that someone started to work on in then marked it as completed but never finishes processing it. So now she did it on the phone and told me to check my transcript in 1 week. I checked it yesterday and not only am I getting the amended credit I filed for but I am now also getting the $1100 recovery rebate credit for my child born in 2020. And the child tax credit webpage now says I am eligible so I should be getting the full 6 month payment in December. If anyone is having a similar issue I suggest calling a tax advocate. I am so glad that I did!
