Out of state medical student

Here's my situation and I hope some experts here can help. Thanks in advance.

 

  • I lived and worked in CA from 1/1/2023 - 6/30/2023
  • I went to New York on 08/01/2023 to start my medical school and rented an apartment there
  • I had NO income from NY last year
  • My lease car was registered in NY 
  • I changed my CA driver license to a NY driver license and registered to vote in NY at the end of Oct, 2023
  • I had a small amount of dividend and interest from my investments in 2023

In TurboTax:

  • Do I specify California or New York for "State of Residence"?
  • Should I select 'Yes' for "XXX lived in another state in 2023"?
  • If 'Yes', what state should I specify for "Previous state of residence"?
  • Do I need to file NY state tax (besides CA) because I have a small amount of dividend and interest from my investments?
  • Is CA still considered my permanent resident since I am an out-of-state student even though I have a NY driver license and registered to vote there?

Since you lived and worked in CA, it sounds like you were a part year CA resident. You moved, changed your license and voting so it does seem that you are establishing NY residency.

 

It sounds like PY CA and PY NY. For NY, the requirements to file are:

If you are a New York State part-year resident you must file Form IT-203, Nonresident and Part-Year Resident Income Tax Return, if you meet any of the following conditions:

  • You are a part-year resident with any income during your resident period or you had New York source income during your nonresident period and your New York adjusted gross income Federal amount column (Form IT-203, line 31) exceeds your New York standard deduction.
     
  • You want to claim a refund of any New York State, New York City, or Yonkers income taxes withheld from your pay.
     
  • You want to claim any of the refundable or carryover credits available.
     
  • You are a part-year resident and you are subject to a separate tax on any lump-sum distributions  for your resident period derived from or connected with New York sources.
     
  • You had a net operating loss for New York State personal income tax purposes for the tax year, without having a similar net operating loss for federal income tax purposes.

You may have additional filing responsibilities if you are a New York City or Yonkers part-year resident, have Yonkers income, or are subject to the MCTMT.
