That's what I'm confused about. We're legally married, but we are separated, and only she was going to file the kids. It's my understanding, that I don't have to file them, but since her taxes are already done, do I have to put married, or can I put separated?

Her tax lady from H&R Block, wouldn't allow us to file separately last year, but allowed us this year, and I'm just trying to get my side of the taxes done.

You will file as married filing separately and not claim your children on your tax return.
