Couple not marred living together the man claims head of household during tax year the women claims single for tax year but the man lost his job only worked January to July 2023. The women goes to work can she claim head of household from July to December 2023. They have two children one born 02/08/2015 and one born 06/18/2023.

Not exactly, as you describe your situation.

 

Two people can both claim Head of Household filing status while living in the same home however, but both will need to meet the criteria necessary to be eligible for Head of Household status:

  • You both are unmarried
  • You both are able to claim a dependent as a closely related person
  • That dependent resides at the same residence for more than half the year.
  • They both have paid more than half of the cost of keeping up the portion of the home for themselves and their dependent(s).

You must both meet ALL of the above requirements in order for each of you to file as Head of Household (claiming one child each).

 

Otherwise, one of you may claim Head of Household (claiming both children) and one of you can file as Single (with no children).
