Filing taxes for my ward as his Guardian of Person and Guardian of Estate.

I am filing taxes for my brother (herein referred to as my ward) who lives in another state.  I am his court appointed guardian of the person and guardian of the estate.  He has been receiving only SSI for his adult life, so he has never had to file taxes.  This year he received a Schedule K -1 because of the portfolio income as beneficiary of an estate.

Several questions:

1. When I file taxes for my ward using my Turbo Tax, do I put his address and phone on the 1040?

2. Do I use the "in C/O option" to list my name as fiduciary?

3. How do I sign the tax form?

You should probably use your address and phone number as his court-appointed guardian. Using "c/o" is optional. Basically, the personal information is used for IRS correspondence - which should most likely come to you and not your ward.

 

You can sign the tax return since you are his legal guardian and prepared the tax return on his behalf.

If I use my address, which is California, can I still file his Wisconsin State taxes where he lives full time?

Yes.  There may be a space to enter in the address where he lives in order to calculate taxes and credits but that would not be the main address.  The main address used is the address where correspondence should be sent and that is your address.
