Dual Status - First Year Choice

I plan to file dual status first year choice for 2023 after completing the required number of days in 2024.

 

I calculated in TurboTax and expect a refund.  I didn't file the extension for my return because of that. 

 

Am I still okay to file the 1040 forms and form 8938 after the required number of days even though I didn't file the extension?

 

I checked the IRS page on it and it says one 'can' file an extension but I'm not sure if it's an absolute must.

Dual Status - First Year Choice

Form 8938 is required to be filed by the due date (including extension). If you are required to file the form and didn't file it by the due date (04/15), and did not file an extension, then you are late filing it. I suggest you file it ASAP.
